Acceptance and eligibility

These Terms and Conditions (“Terms”) are a binding agreement between you and Garagester governing your access to and use of the Garagester websites, forms, sale pages, search tools, communications, and private management features (collectively, the “Service”).

By using the Service, submitting a sale, or clicking an agreement checkbox, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to submit or manage a sale. If you use Garagester on behalf of an organization, you represent that you have authority to bind that organization.

What Garagester provides

Garagester is a local discovery and listing service. It helps sellers describe sales and helps shoppers find sale dates, photos, categories, locations, and directions.

Garagester is currently a public alpha. Features may be changed, limited, interrupted, or removed while the service is tested and improved.

Seller responsibilities

When you submit or manage a sale, you agree that:

• you are authorized to advertise the sale and publish information about the property or event;
• the address, dates, hours, photos, item categories, descriptions, and other details are truthful and current;
• you will promptly update, cancel, or report a listing that becomes inaccurate;
• you will follow applicable laws, permits, neighborhood rules, sign rules, and safety requirements;
• you will respect neighbors, keep access routes clear, and avoid creating unsafe traffic or parking conditions; and
• you will comply with the Garagester Listing Rules.

Publishing a listing does not mean Garagester has verified every fact, inspected the location, or approved every item.

Your content and permissions

You retain ownership of content you submit, including photos, descriptions, and sale information. You grant Garagester a worldwide, nonexclusive, royalty-free license to host, store, reproduce, resize, crop, format, publish, display, distribute, and promote that content solely to operate, improve, and market the Service and the relevant sale. This license ends when the content is deleted from our active systems, except for reasonable backup, legal, and previously shared copies.

You represent that you own the content or have all permissions necessary to submit it, and that our permitted use will not violate another person’s privacy, publicity, intellectual property, or other rights.

Feedback and suggestions may be used without restriction or compensation, but we are not required to use them.

Prohibited conduct and items

You may not use Garagester to:

• publish a false address, fake sale, misleading photo, or deceptive description;
• list stolen, counterfeit, recalled, unsafe, illegal, or unlawfully obtained property;
• offer weapons, controlled substances, regulated goods, animals, or other items when the offer or sale would violate law or our rules;
• harass, threaten, discriminate against, stalk, exploit, or invade the privacy of another person;
• scrape, harvest, sell, or misuse addresses, contact details, listing content, or other Service data;
• upload malware, interfere with security, overload the Service, bypass access controls, or reverse engineer protected features; or
• use the Service for spam, unrelated advertising, or any unlawful or harmful purpose.

Sales, safety, and third parties

Any purchase, payment, pickup, negotiation, refund, dispute, or other interaction is solely between the seller and shopper. Each person is responsible for evaluating items, prices, payment methods, property conditions, parking, and personal safety.

Never use Garagester or scan a QR code while driving. Follow posted hours, park legally, supervise children, respect private property, and leave if a situation feels unsafe. Review our Safety guidance.

The Service may link to Google Maps, communication providers, payment services, or other third parties. Their products and practices are governed by their own terms, and Garagester is not responsible for third-party services.

Moderation and termination

We may review, refuse, edit for formatting or clarity, hide, expire, suspend, or remove a listing or access to the Service if we reasonably believe it is inaccurate, unsafe, unlawful, unauthorized, expired, harmful, or inconsistent with these Terms. We may ask for identity, address, or authorization verification before publication.

You may stop using the Service at any time. A seller may request cancellation or removal by contacting hello@garagester.us. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability, indemnification, and general terms.

Garagester ownership

The Service, including the Garagester name, logo, software, design, layout, original text, and technology, is owned by or licensed to Garagester and is protected by applicable laws. These Terms do not transfer ownership to you.

We grant you a limited, revocable, nonexclusive, nontransferable license to use the Service for its intended personal or organizational purpose while you comply with these Terms.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” GARAGESTER DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SAFETY, AVAILABILITY, AND RESULTS.

We do not guarantee that a sale will occur, that a listing or address is accurate, that any item will be available or lawful, that a person is who they claim to be, or that the Service will be uninterrupted or error-free. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.

Liability and indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GARAGESTER AND ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSSES ARISING FROM A LISTING, SALE, TRANSACTION, THIRD PARTY, OR USE OF THE SERVICE.

To the maximum extent permitted by law, Garagester’s total liability for all claims relating to the Service will not exceed the greater of $100 or the amount you paid Garagester for the relevant Service during the 12 months before the claim. These limitations do not apply where prohibited by law.

You agree to defend, indemnify, and hold harmless Garagester and its operators, affiliates, and service providers from claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your listing, content, sale, items, property, violation of law, or breach of these Terms.

General terms

Changes

We may update these Terms by posting the revised version and a new “Last updated” date. Material changes will apply prospectively, and we will provide additional notice when required by law. Continuing to use the Service after the effective date means you accept the revised Terms.

Governing law and disputes

Missouri law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and try in good faith to resolve the dispute informally for at least 30 days. Unless applicable law requires otherwise, courts located in Jasper County, Missouri will have exclusive jurisdiction.

Miscellaneous

These Terms, the Privacy Policy, and incorporated Listing Rules are the entire agreement about the Service. If one provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of operating or transferring the Service. We are not liable for delays caused by events beyond our reasonable control.
